Attacks Against Constitution Are Continuing Under Modi

By
Shameem Faizee

After getting assured that the Sangh
Parivar has got what it wanted on the Ayodhya issue, the Narendra Modi
government has intensified new attacks on the basic structure of the Indian
Constitution. In the last fortnight, the government officially floated the idea
of handing over the most part of the acquired land around Babri Masjid and got
approval from its supporters. Not much surprising, the so called secular forces
too kept mum or endorsed the idea.

That was good enough for the Hindutva
forces. They had taken as government approval, the handing over of the acquired
land ultimately to the Ram Nyas which was given to it a few months before the
demolition by the then UP Chief Minister Kalyan Singh. Now they think that
except the portion where Babri Majid stood, the rest of the land in and around
disputed site is owned by Hindutva Organisations. That is not true. But when
nobody challenges such claims, the claimants take it for granted.

Vishwa Hindu Parishad (VHP) has
declared that it is in no haste to build the Ram Mandir at the disputed site.
It thinks government has conceded its demand and now Mandir could be built at
any time.

After having established the
“ownership” on the land in Ayodhya, the same forces under the patronage of the
government are trying to impose indirectly the two nations theory of Savarkar
via North Eastern states.

Despite opposition by the BJP cadres
and leaders in these states, the central government is bent upon imposing the
socalled Citizenship Register in the entire North East. Actually it is an
attempt to destroy the identity of various regions of NE and superimpose
Hindutva by allowing migrants from neighbouring country.

The law is very clear that only
non-Muslim minorities from Pakistan, Bangladesh and Afghanistan will be given
citizenship in these states. This is modern version of Savarkar’s two nation
theory. If the resistance in the NE does not succeed , it will be a big blow on
the Constitution of India that does not recognise citizenship on the basis of
religion. It will erode the secular ethos of the Constitution.

Secular forces should not treat the
struggle against citizenship registry just as a case involving only the
residents of NE. It will have far reaching consequences for the entire country.
North-Eastern states have dozens of ethnic, racial and linguistic communities
with their own traditions and culture. Even they do not follow the Hindu
marriage, Inherent laws and other traditional laws of Hindu society. Their
separate personal laws are recognised. That is what the Hindutva forces want to
end.

Another attack this week on the
Constitution, though complicated, was the CBI attempt to take over law and
order in Kolkata. There is no doubt that the ruling party in Bengal, the
Trinamool Congress is fully involved in different scams, particularly those
involving lakhs of people in chit fund and such other scandals. It is also true
that, after BJP came to power in Centre, number of scam leaders shifted loyalty
to BJP. Most of them are now leaders of BJP. In that way, both BJP and TMC are
equally guilty.

But the way BJP has used the CBI on
last Sunday to question the Police Commissioner at his residence cannot be
approved. Actually, after getting a new CBI chief, a crony of NSA Ajit Doval,
such atrocious actions were expected. Law and order is a state subject and any
police action has to be taken with the help of the police.

Here the CBI went straight to Police
Commissioner‘s office to take action against him. This at the best can be
called atrocious that the apex court has also disapproved. One may have
political differences with regional ruling parties here and there but bigger
threat of fascism posed by the Sangh Parivar cannot be side-tracked.

Actually, the BJP used the CBI in
Kolkata when the Left organised a historic rally in Brigade Parade ground. The
media of course, otherwise would have downplayed the rally but it used the CBI
raid to further side track the rally.

Left has to be over-cautious on such
occasions. It is true that while doing everything possible to oust the BJP from
power, in West Bengal, the Left is equally committed to oust TMC from power. (IPA Service)

An appeal

The legacy of IPA, founded by Nikhil Chakravartty, the doyen of journalism in India, to keep the flag of independent media flying high, is facing the threat of extinction due to the effect of the Covid pandemic. Only an emergency funding can avert such an eventuality. We appeal to all those who believe in the freedom of expression to contribute to this noble cause.
